Dear Sir,

1.      As you are aware, vide our Circular No. 345 dated 21/06/05, Government of India has liberalized certain procedures /requirements of Student Visa Regime (copy enclosed). In order to minimize the inconvenience to the foreign students, powers to extend, change Institute/course in same Institute have been delegated to the State Government/FRROs, as the case may be. The intention is to eliminate the requirement of the foreign students to rush to Ministry of Home Affairs, Delhi for such services.

2.      It has, however, come to our notice that application of foreign students, who are    approaching the officers of FRROs/FROs for extension/change of Institute/course of study, etc. are not being entertained and they are being asked to visit Ministry of Home Affairs' Visa Facilitation Centre in Jaisalmer House, New Delhi. The Embassies of various countries have complained of such difficulties being faced by foreign students.

3.      I would, therefore, request you to kindly sensitize the concerned officers in Home Department and all FROs in your state to exercise the delegated powers in taking appropriate decision in cases being presented to them by foreign students. Only such cases should be referred to MHA wherein the State Government/FROs feel that they need clearance of the Government of India for specific reasons and they are not within their delegated power. This would go a long way in minimizing the avoidable harassment to the foreign students.
